Who We Are
This Privacy Policy explains how Fan Giftz, LLC collects, uses, stores and shares information when you visit our website, contact our studio, place an order or receive a gift that we prepared. The policy is published by Fan Giftz, LLC, a limited liability company registered in the State of Utah, with its principal place of business at 87 Mountain Way Dr, Orem - 84058-5151, United States (US).
The website and the studio are operated by the developer identified in our public materials as Fan Giftz. That developer is responsible for the day to day handling of enquiries, order records and the gift projects that pass across our wrap counter. The company and the developer work as one team, and a request sent to either of them reaches the same small studio.
In this policy the words we, us and our refer to Fan Giftz, LLC. The words you and your refer to any visitor to the website, any person who contacts the studio, any customer who places an order, and any person who receives a gift that we assembled on behalf of a customer. Where the policy speaks about a gift recipient, it means a person who did not necessarily deal with us directly but whose details a customer shared so that a parcel could be delivered or a tag could be lettered.
Our studio curates fan gifts and custom merchandise. We assemble themed gift boxes, prepare custom wrap and tie work, build keepsake kits, produce event favor runs, letter personalized gift tags and run subscription gift plans. Each of these services can involve personal information, and this policy describes how that information is treated across all of them.
We are a small workshop and we write our policies the way we work: plainly, in ordinary language, and with an eye on what a reader actually needs to know. If any part of this policy is unclear, you are welcome to write to us at office@fangiftz.autos and ask for a plain explanation.
Scope of This Policy
This policy applies to the website published at fangiftz.autos and to every service we provide from our Orem studio. It covers information gathered through our contact form, by email, by telephone, during an appointment at the studio, and through any paper or digital forms that a customer completes when a project begins.
The policy does not apply to websites operated by other companies, even when we link to them or when a customer reaches our studio through their platform. It also does not apply to the internal records of a customer who orders gifts for their own staff or clients. Those records belong to that customer and are governed by that customer own privacy notices.
If you are a gift recipient and you never contacted us, this policy still describes how we handle the small amount of information that a customer may have shared about you, usually a name, a delivery address and a short message for a tag. Section five explains that situation in more detail.
This policy does not create any right to a particular outcome in a particular order. It describes our general practices. Specific commitments about a project, including delivery dates and replacement terms, are set out in the Terms of Service and in any written project confirmation that we send to a customer.
Information We Collect
We collect a limited set of information, and we try to collect only what a project actually requires. The categories below describe what we may hold at any given time.
Contact and identity details
When you contact the studio or place an order, we may collect your name, email address, telephone number, postal address and, where relevant, the name of the organization you represent. We use these details to reply to your enquiry, confirm a project, send a dispatch notice and resolve any question that arises afterwards.
Project and order details
We keep the brief for each project, including the occasion, the number of parcels, the theme, the chosen materials, the approved sample notes and the delivery plan. This record lets us build a consistent run and answer questions months later without relying on memory.
Personalization details
Some services require short pieces of text that will appear on a finished object. A personalized gift tag may carry a name, a date or a short message. A keepsake kit may include printed prompts filled in by contributors. We treat this material as project content and handle it with the same care as the rest of an order.
Gift recipient details
Where a customer asks us to send parcels directly to recipients, we may receive recipient names, delivery addresses and short notes for tags. We use this information only to complete the order and to help resolve a delivery problem.
Payment and billing records
We keep records of invoices, payments received and any refund issued. Card numbers are handled by a payment provider and are not stored by our studio. What we retain is the transaction reference, the amount and the date, which is needed for accounting and for confirming that an order was paid.
Communications
We keep emails, messages and notes from telephone conversations that relate to a live or past project. These records help us honor a commitment, check an approved detail and answer a question about a past order.
Technical information
When you visit the website, our hosting provider may record standard technical information such as the browser type, the operating system, the approximate region derived from an internet address and the pages visited. We use this information to keep the site available and to understand which parts of it are useful.
How We Collect Information
Most of the information we hold comes directly from you. You type it into the contact form, send it in an email, say it during a telephone call or write it on a project form during a studio appointment. When a customer supplies details about gift recipients, that information reaches us indirectly but is collected for the same project purpose.
A smaller amount is generated automatically. The website itself does not run a heavy tracking system, but our hosting provider may create basic server logs when a page is requested. If a project confirmation is sent by email, the email provider records the delivery in the ordinary way that email systems do.
We do not buy personal information from data brokers, and we do not compile profiles of visitors for sale. We do not use hidden tracking pixels on our own pages, and we do not attempt to identify anonymous visitors by combining technical records with other sources.
Where a customer uses a shared mailbox or a team address to contact us, we treat the person who writes as the contact for the project unless the customer tells us otherwise. If a project changes hands inside a customer organization, we ask for a short written note confirming the new contact so that personalization details are not sent to the wrong person.
Legal Bases for Processing
Where privacy law requires a legal basis for processing, we rely on one or more of the following grounds.
- Performance of a contract. We process contact details, project details and delivery information because they are necessary to prepare a quote, fulfil an order and deliver the parcels that a customer has asked us to make.
- Legitimate interests. We keep business records, respond to enquiries, protect the studio from misuse and improve our services. These activities support the running of a small workshop and do not override the interests of the people whose information we hold.
- Consent. Where we ask for permission, for example to send occasional studio news by email, we rely on the consent you give and you may withdraw it at any time.
- Legal obligation. We keep certain accounting and tax records because the law requires it, and we may disclose information where a lawful request compels us to do so.
When we rely on legitimate interests, we balance those interests against your rights. We collect little that is sensitive, we limit retention, and we do not use project content for unrelated marketing. If you believe our balancing has gone wrong in your case, you can object using the contact details at the end of this policy.
Order Fulfilment and Gift Recipients
A large share of our work involves sending parcels to people who did not place the order. A customer supplies a recipient name, an address and sometimes a short message, and we use that material only to prepare, label and dispatch the gift.
We do not add gift recipients to a marketing list, we do not write to them about future projects, and we do not pass their details to any party other than the courier that carries the parcel and the payment or accounting providers that support the transaction.
If a recipient contacts us after receiving a gift, for example to ask about an allergy or to request that a tag be removed from a photograph, we will help where we can. We may ask the customer who placed the order to confirm the request before we change or delete a record, because the order record belongs to that customer.
Recipient details are kept only as long as they are needed for delivery, for resolving a delivery problem and for the ordinary accounting record of the order. After that period they are removed or reduced to a reference that no longer identifies the person.
Personalization and Tag Data
Personalized tags and keepsake kit prompts often contain names, dates, short messages and occasionally a photograph or a scanned note. This is the most personal material we handle, and it is handled by a small number of people on the studio team.
We ask customers to send personalization text in a single message with the project reference so that it can be attached to the correct order. We confirm the text back before production begins. Where a message could be misread, for example when two people share a name, we read the text back once more before cutting the final card.
We do not publish customer tags, kits or project photographs on our website or on social media without written permission. When permission is given, it can be withdrawn at any time, and we will remove the image from pages we control within a reasonable period.
Personalization material is retained with the order record so that a replacement or a matching second run can be produced. A customer may ask us to remove it after the order is complete, and we will do so unless we are required to keep the order record for accounting purposes.
Measurement and Analytics
We want to know whether the website is answering the questions that visitors bring to it. To understand that, we may review aggregate counts such as the number of visits to the services page or the number of contact form submissions in a month. These counts are reviewed in totals and are not used to single out an individual visitor.
When a search engine or a business directory refers a visitor to our site, we may see the aggregate referral count from that source. We use it to decide where to keep our public listing accurate. We do not attempt to connect a referral to an identifiable person.
We do not sell analytics data, and we do not share it with advertising networks. If a measurement provider processes data on our behalf, it is bound by a contract that limits its use of the data to the service it provides to us.
Service Providers and Subprocessors
Like most small businesses, we rely on a handful of providers to run the studio. Each provider receives only the information needed for its part of the work, and each is expected to protect it.
Our website hosting provider stores the site files and generates basic server logs. Our email provider carries the messages that customers send to the studio inbox. Our payment provider processes card transactions. Our courier partners carry finished parcels. Our accounting tool keeps the invoices and payment records that the law requires us to retain.
Where a provider processes personal information on our behalf, we choose providers that offer reasonable contractual protections and we limit the data they receive. If a provider is replaced, we take steps to ensure that the old provider returns or deletes the information it held for us and that the new provider is bound by comparable obligations.
We do not use a provider that repurposes our customer data for its own advertising. If we ever discover that a provider has done so, we will end the relationship and notify affected customers where the law requires it.
Payments and Financial Data
Payments for studio projects are processed by a payment provider. The provider receives the amount, the invoice reference and the contact details needed to issue a receipt. Card numbers are entered directly with the provider and are not stored in our systems.
We keep a record of the invoice, the amount paid, the date and any refund. These records support accounting, tax reporting and the resolution of a payment dispute. They do not include a full card number.
If a payment is made by bank transfer, we receive a reference and the name on the account. We keep that record with the invoice so that the payment can be matched to the order. We do not ask customers to send card details by email, and we will never request a password or a one time code in a message about an order.
Data Retention
We keep information only as long as it serves a purpose. Enquiries that do not become projects are usually removed within twelve months. Project records are kept for the duration of the work and for a reasonable period afterwards so that we can answer questions, produce a matching second run and resolve a dispute.
Accounting and tax records are kept for the period required by law. Delivery details for gift recipients are kept only as long as they are needed to complete the delivery and to resolve a problem, after which they are removed or reduced to a reference that does not identify the person.
Personalization text is kept with the order record for the same period as the order, because it may be needed to produce a replacement or a matching item. A customer may ask for it to be removed earlier, and we will comply unless a legal obligation requires us to keep the record.
When a retention period ends, we delete the information or reduce it to a form that no longer identifies a person. Backups are rotated on a regular schedule, so a deleted record may persist in a backup for a short time before the rotation removes it.
How We Protect Information
We protect information with practical measures suited to a small studio. Access to order records is limited to the people who need it to complete the work. Devices used for project records are protected with a passcode and kept up to date. Paper order sheets are stored in a locked drawer once a project is finished.
The website is served over an encrypted connection. Contact form messages are delivered to the studio inbox by the visitor own mail application, which means the message does not pass through a separate form server. Payment data is handled by a provider that meets card industry standards.
No method of storage or transmission is perfectly secure. We cannot promise that a breach will never occur, but we review our practices regularly and we act quickly if a problem is found. If a security incident affects personal information and the law requires notification, we will notify affected people and the relevant authority without undue delay.
Your Privacy Rights
Depending on where you live, you may have some or all of the following rights.
- Access. You may ask for a copy of the personal information we hold about you.
- Correction. You may ask us to correct information that is inaccurate or out of date.
- Deletion. You may ask us to delete information that we no longer need, subject to legal retention requirements.
- Restriction. You may ask us to limit how we use your information while a question is resolved.
- Objection. You may object to processing that we base on legitimate interests.
- Portability. You may ask for a copy of the information you provided in a common machine readable format.
- Withdrawal of consent. Where we rely on consent, you may withdraw it at any time without affecting work already completed.
To exercise a right, write to office@fangiftz.autos with enough detail for us to locate your record. We may ask for a small amount of confirming information so that we do not release a record to the wrong person. We respond within the period required by applicable law, and we do not charge a fee unless a request is clearly excessive.
If your request concerns a gift you received, we may need to confirm the request with the customer who placed the order before changing the order record. We will explain any such step rather than simply refuse the request.
Notice for California Residents
California law gives residents specific rights over personal information. In the preceding twelve months we may have collected identifiers such as a name and email address, commercial information such as order history, and internet activity information such as the pages visited on our site. We collect these categories for the purposes described in this policy.
We do not sell personal information as that term is defined by California law, and we do not share personal information for cross context behavioral advertising. We do not knowingly collect or sell the personal information of a consumer under sixteen years of age.
California residents may request to know the categories and specific pieces of personal information we hold, request deletion, request correction and request to opt out of sale or sharing. Because we do not sell or share personal information for advertising, an opt out request will be recorded and confirmed even though there is no sale to stop.
We will not discriminate against a person for exercising a privacy right. A request can be made by email to office@fangiftz.autos or by telephone on +16079901062. We will verify the request using information already in our records and will respond within the statutory period.
Privacy for Children
Our website and our services are intended for adults who are arranging gifts. We do not knowingly collect personal information from a child under thirteen. If a project involves gifts for children, the order is placed by a parent, a guardian or an organization, and the information we hold belongs to that adult or organization.
Personalization text for a child, such as a name on a tag, is supplied by the adult who placed the order. We use it only to complete the item and we do not create a separate record about the child.
If you believe that a child has sent personal information to the studio without the involvement of a parent or guardian, please contact us at office@fangiftz.autos. We will delete the information promptly once we confirm the situation.
International Visitors
The studio is based in the United States, and our records are kept on systems that may be located in the United States. If you visit the website or contact us from another country, you understand that your information may be transferred to and processed in the United States.
Where a transfer is subject to specific legal safeguards, we rely on the standard contractual terms offered by our providers and we limit the information transferred to what the relevant service requires. We do not transfer project content to a provider that has no contractual obligation to protect it.
Visitors from regions with their own privacy laws may have additional rights. We honor valid requests under those laws wherever we can identify the applicable framework, and we will explain our reasoning if a request cannot be met in full.
Marketing Communications
We send marketing email only to people who have asked for it. A request made during an enquiry does not automatically add you to a list. Where the law permits a soft opt in for existing customers, we keep the message relevant to the studio and we include a way to stop receiving it.
Every marketing message includes an unsubscribe instruction. A request to unsubscribe is honored promptly, and we keep a minimal record of the request so that we do not add the address again by mistake. Transactional messages about a live order, such as a brief confirmation or a dispatch notice, are not marketing and are sent regardless of marketing preferences.
We do not sell or rent an email list, and we do not use a purchased list for any purpose. The only list we hold is the one that people have joined themselves.
Third Party Links and Features
Our pages may link to a map, a courier tracking page, a payment portal or a social profile. When you follow a link, you leave our site and the privacy notice of the other provider applies. We choose links that are relevant to the studio, but we do not control the practices of the sites we link to.
Some pages include a link that opens an email application on your device. That application is provided by your own software or email service, and the message you send is handled by that provider as well as by our studio inbox.
If we embed an outside feature in the future, we will describe it on the page where it appears and, where required, ask for consent before the feature loads.
Changes to This Policy
We review this policy from time to time. When a change is small, such as a clarification of wording, we update the page and keep the same effective date where the meaning is unchanged. When a change affects how we use personal information, we update the effective date and, where the law requires it, notify affected people by email.
The current version is always the one published on this page. We encourage customers and visitors to review it occasionally, particularly before starting a new project that involves personalization or gift recipient details.
If a change would require consent and you do not give it, the previous practice will continue to apply to information collected before the change, unless the law requires otherwise.
Complaints and Escalation
If you are unhappy with how we have handled your information, please tell us first. A clear message to office@fangiftz.autos is usually enough for us to correct a record, explain a decision or change a practice. We treat a complaint as a signal that something in our process needs attention rather than as an inconvenience.
We will acknowledge a complaint within a few business days and aim to resolve it within thirty days. If the matter is complex, we will explain the delay and give a date for the next update.
You also have the right to complain to a privacy regulator in your region. We will cooperate with a regulator that is investigating a complaint about our practices.
How to Contact Us
Questions about this policy, requests to exercise a privacy right and complaints about how information has been handled may be sent to the studio by any of the means below.
